Rewards Program Terms & Conditions
(“Program Terms”)

  1. Program Eligibility & Purpose:

The Stafftrack™ Rewards Program (“Program”) is offered by Staff Management Solutions, LLC; SMX, LLC, and SMX Cargo, LLC (collectively, “Staff Management”) and SIMOS Insourcing Solutions, LLC (“SIMOS”).

All individuals employed in hourly positions with Staff Management or SIMOS providing on-site services for Staff Management or SIMOS customers (“Associates”) shall be eligible for participation in the Program.

The Program is intended to provide Associates with a centralized recognition program allowing Associates to earn points for certain defined actions, accomplishments, and/or milestones (“Points”).

All Associate participation in the Program shall be governed by these Program Terms.

  1. Program Period & Entrance:

The Program Period shall begin on March 24, 2022 (“Program Start Date”) and continue until otherwise terminated by Staff Management and/or SIMOS as provided under these Program Terms (“Program End Date”).

All Staff Management and/or SIMOS Associates with active status in Stafftrack™ as of the Program Start Date will be automatically enrolled in the Program.

All Staff Management and/or SIMOS Associates hired after the Program Start Date will be automatically enrolled in the Program upon their hire/start date as a Staff Management and/or SIMOS Associate.

Any Staff Management and/or SIMOS Associate who is terminated in Stafftrack™ will forfeit any Points as of the date of the Associate’s termination and will be ineligible to redeem such Points for Rewards.

  1. Point Accumulation & Notification:

Associates may earn Points based on certain actions, accomplishments, and/or milestones as follows:

  2. All Associates active in Stafftrack™ as of the Program Start Date will automatically receive points based on their tenure up to the Program Start Date as follows:

  3. Anniversary & Milestone Points:
  4. All Associates active in Stafftrack™ during the Program Period shall earn Points based on Associate’s tenure.  After the first year of Associate tenure, Associates shall earn additional tenure points as below only on Associate’s annual tenure anniversary.

  5. Refer a Friend:
  6. All Associates active in Stafftrack™ during the Program Period may earn Points for referring individuals through the Stafftrack™ Mobile App or Associate Portal and such referral begins working for Staff Management or SIMOS.

  7. Perfect Attendance
  8. Associates will receive twenty (20) Points for each month in which Associate achieves perfect on-site attendance for each working day during a calendar month. “Perfect Attendance” is defined as the Associate having no unexcused absences in Stafftrack™ during the applicable calendar month. During Associate’s first (1st) month of work, Associate’s start date must be on or before the 10th of the month in which Associate starts work to be eligible for Perfect Attendance during Associate’s first working calendar month.

  9. Points Notification

Associates will receive notification of Points awarded through: (a) e-mail alert from Stafftrackrewards.com; (b) a push notification from the Stafftrack™ mobile app if Associate has enabled push notifications within Associate’s Stafftrack™ mobile app; or (c) through a notification on the Stafftrack™ website.

  1. Reward Options:

Active Associates may redeem Points earned at anytime for the rewards or prizes (“Rewards”) pursuant to the following Reward options. Associates may access their Points earned and the marketplace to exchange Points for Rewards within either (a) the Stafftrack™ Mobile App or (b) the Associate Portal under the Stafftrack™ Rewards icon on the Stafftrack™ website.

 

Option 1: Staff Management and/or SIMOS-Branded Items:

 

Active Associates may redeem Points in exchange for the following Staff Management and/or SIMOS branded items:

Option 2: Raffle Ticket

 

Active Associates have the option of exchanging their Points in exchange for a raffle ticket to a monthly drawing (“Raffle”) with a chance to win one of the “Raffle Prizes” as listed below:

Raffle for Tier 1, Tier 2, and Tier 3 will be conducted monthly. Two (2) winners for each of the three (3) tiers will be chosen during each monthly drawing, with a total number of six (6) Raffle winners per month. Associates may have multiple entries within a Raffle (or different tiers) if Associate has sufficient points for entry.

A random drawing will be conducted by Staff Management and SIMOS on the first week of each month for the previous month’s Raffle entries. Odds of winning depend on the number of Associates entered in the Raffle and tiers. Each Raffle entry shall only be eligible for one (1) drawing, and all Raffle entries for all tiers shall reset for each month’s Raffle drawings. Prize winners may be notified by email, phone, Stafftrack™ mobile app, Stafftrack™ website, or in person at winner’s worksite.

  1. Rights Granted by Associates:

By participating in the Program, Associates understand and agree that PeopleManagement and anyone acting on behalf of PeopleManagement or its respective licensees, successors, and assigns, shall have the right and permission to use Associate’s image, name, likeness, and other biographical information for marketing, advertising, and trade purposes without further compensation or right of approval, unless prohibited by law. Specifically, Raffle Prize winners agree that their image, name, likeness, and other biographical information may be used by Staff Management and SIMOS Associate Engagement and Marketing teams to be posted on the Stafftrack™ Rewards Raffle Winner Website and on the Associate Engagement Yammer Page. All federal and state laws apply.

  1. Miscellaneous:

Staff Management and/or SIMOS may change or amend these Program Terms at any time and for any reason whatsoever, and Staff Management and/or SIMOS reserves the right in its sole discretion to change, modify, alter, amend, or terminate the Program and any Awards at any time with or without notice to Associates.

All Awards and Raffle Prizes shall be subject to all applicable taxes and withholding amounts required by applicable federal, state, and local laws, rules, and regulations. Associates subsequent paycheck will reflect the Award amount for tax and withholding purposes.

Actual/appraised value of certain Awards may differ at time of award. The specifics of The Program shall be solely determined by Staff Management and/or SIMOS.  Staff Management and/or SIMOS reserves the right to substitute any non-cash Award in the case of unavailability.  Awards are non-transferable.  Points have no cash value.

By participating in the Program Associates agree to release and hold harmless Staff Management, SIMOS, and each of its subsidiaries, affiliates, parent organization(s), partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from participation in this Program or acceptance, use, or misuse of any Award.

Associates agrees that all matters arising out of or relating to this Program and these Program Terms are governed by, and construed in accordance with, the laws of Washington, without respect to conflict of law doctrines. By participating in this campaign, Associates agree that all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Program and these Program Terms, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Pierce County, Washington having jurisdiction.
